*Customers must inspect all shipments before signing clear on delivery receipt*
Unless otherwise agreed at the time of delivery, all shipments are free of charge. Sintex will determine the point of origin of shipment, the method of transportation, and the routing of shipment. All freight charges are the sole responsibility of the purchaser/customer. Purchasers requesting shipment by a method other than that of Sintex’s selection will be billed for any additional charges incurred. Sintex, when possible, will attempt to make shipments by the routing requested by the purchaser, but makes no guarantee. All added accessories fees will be charged to the customer. (i.e. residential, lift-gate, re-consignment.) It is the consumer's responsibility to inform us prior to delivery if the location for delivered cannot accept a trailer delivery vehicle. Deliveries that cannot be made due to vehicle size or access restriction will be billed as delivered. If a delivery is possible with another vehicle, re-delivery will be made and an additional delivery fee will be charged. If you need any added accessories please call us and we will do our best to add these at our prices so you are not charged at the carriers public rates.
Trucks ranging from 12’ to 65’ in length may deliver your merchandise. In most cases, they cannot enter private driveways or roads, as there is insufficient room to manoeuvre and turn around. When this is the case, prior arrangements must be made to deliver your order to a predetermined location, preferably the nearest public road access to the original destination address.
The act of signing for delivery is the acceptance that your product has arrived undamaged. The person who signs the Proof of Delivery (POD) when products are delivered MUST note any visible damage on the POD. Often, the damage is done to a piece that can easily be replaced. If you have ANY questions regarding the condition of the product please call Sintex, while the driver is there and before you sign the delivery receipt and we gladly help you with a resolution. Cosmetic and surface scuffs and scrapes can happen in transit. Surface scrapes will not impact the product's structural integrity or void your warranty and do not constitute damage. Please take pictures, if possible, and contact Sintex immediately upon discovery for evaluation and proper resolution. You DO NOT have to accept the product if you have any questions regarding the condition of the product, please refuse the product or note damage on the delivery receipt and contact Sintex immediately. products may become soiled in transit. Dirty products DO NOT constitute damage and damage claims will be refused.
Our products leave our vendors in good condition. Once they are turned over to the carrier, damage can occur. If there is no notation of damage on the signed POD, the purchaser has accepted that the product has arrived, has been inspected and is in good condition. It is important that the purchasers thoroughly look over the products for damage and if there is damage they are required to note it on the POD or refuse the product.
If there are any damages Sintex should be notified immediately help ensure timely resolution.
It is the purchaser’s responsibility to notify Sintex of all damages within 5 business days from delivery.
We value our customers and will do everything to get the customer a new product at no extra charge, as long as the damage is noted at the time of delivery. We will NOT accept responsibility for damage done to the product if the receiver of the product does not note damage. At this point, you will accept ALL responsibility for the product and can file a claim directly with the carrier for the damage. We will be happy to assist you with this process.
All displayed transit times are estimates only and do not include the day of pickup. Pickup dates are not guaranteed. Pickup day is not included in the calculation of LTL transit time. The customer is liable for all charges related to the shipment. You will be provided with a tracking number and we will assist you in making every effort in our control to ensure that the order is delivered in a timely manner. Shipping dates are approximate and are based on prompt receipt of all necessary information and approvals from the purchaser. Sintex shall not be liable for failure to perform or for delay in performance due to fire, flood, strike, or other labour difficulties, acts of God, act of any governmental authority or of the purchaser, riot, embargo, state or national bandh, car shortage, wrecks or delay in transportation, inability to obtain necessary labor, materials or manufacturing facilities from usual sources or due to any other cause beyond its reasonable control. In the event of delay in performance due to any such cause, the date of delivery or time of completion will be postponed by such length of time as may be reasonably necessary to compensate for the delay.
Guaranteed Service transit times do not include holiday and/or no service days as defined by the individual carrier. Shipments not delivered within date/time specified on the bill of lading may not be considered a service failure when the reason for the delivery delay is deemed as no fault of the carrier. These reasons could include, but are not limited to, the following conditions: acts of God; the existence of violence, embargo, bandh, riots, military action or such possible disturbance as creating reasonable apprehension of danger; acts or omissions by: shipper, consignee, owner of goods or public authority; delays due to customs clearance or documentation required for movement of shipment; closure of Nation, State, City or local roads, streets, or highways resulting in travel delays by carrier; shipments not accepted by the consignee when offered for delivery. This service is not a guarantee for pickup. Customers will be reimbursed for shipping if guaranteed delivery is requested in writing by the customer and the guaranteed date is not met.
SINTEX CANNOT ENSURE THAT ANY SHIPMENT CAN BE MADE BY ANY SPECIFIC TIME OR DATE. IN ANY EVENT, THE COMPANY SHALL NOT BE LIABLE FOR COSTS, INCLUDING BUT NOT LIMITED TO ANY SPECIAL, INCIDENTAL OR CONSEQUENTIAL DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS OR INCOME.
